WHY THIS CAMPAIGN IS CRUCIAL
This campaign is necessary because, despite widespread documentation of these problems, including parliamentary inquiries and official reports, coastal communities and water consumers continue to suffer. COCOO.uk has engaged with Ofwat, the Environment Agency, specific water companies like Thames Water, and government departments including the Ministry of Housing, Communities and Local Government, and HM Treasury, to understand the challenges and advocate for improvements. We believe that a collective approach is essential to hold responsible parties accountable and to seek redress for the damages incurred, as individual efforts may be insufficient to address such systemic problems

ACTUAL AND POTENTIAL HARM

Potential causes of action, particularly in tort, and the resulting harms include: claims against water companies for nuisance (both private and public) and negligence due to the harmful effects of sewage discharges on property, local businesses, public health, and general amenity. Regulators such as Ofwat and the Environment Agency could potentially face claims for negligence if it is established that they failed in a specific duty of care to prevent such harm by not acting on known dangers or by failing to enforce regulations effectively. Similarly, Local Planning Authorities might be liable in negligence for specific flawed decisions, and entities responsible for coastal or water management schemes could be liable for negligence or nuisance arising from their implementation or operation. The harms suffered can range from damage to property and health impacts, to economic losses for businesses, and the loss of enjoyment of public coastal areas.
